| Eligible Entrant | To be eligible to enter this Competition, an individual must: 1. permanently reside in an Australian State or Territory; 2. not be an employee or business partner of the Promoter, or an immediate family member of either of them; 3. be at least 10 years of age, or such other minimum age which is required to use Facebook or Instagram; and 4. for persons under 18 years of age (but who are at least the minimum age specified above), participating in the Competition with the approval of their parent or legal guardian. |
| Eligible Entry | 1. Entries must be submitted by an Eligible Entrant during the Entry Period and otherwise comply with this Schedule and the accompanying terms and conditions. 2. Entries must be submitted: (a) in a JPEG (.jpg), PNG or SVG format; (b) with a minimum resolution of 400 x 300 pixels; (c) without any watermarks or other featured branding; (d) without any image of a natural person who can be identified from the image; and. (e) as an original, scenic photograph which has been taken by the Eligible Entrant from the Melbourne Skydeck or observation deck (Level 88) at 7 Riverside Quay, Southbank, in Victoria, Australia. |

| Entry Method | To enter, Eligible Entrants must upload an original, scenic photograph without any images of natural persons who can be identified from the image: 1. directly via the Competition link available at www.melbourneskydeck.com.au/photo-competition; or 2. on the Promoter’s Instagram page at @melbourneskydeck or Facebook page at ‘Melbourne Skydeck, with the Nominated Hashtag used either in the photograph or in the caption attached to the photograph. |

TERMS AND CONDITIONS
Agreement
- By entering this Competition, you agree to these terms and conditions which will be legally binding. In exchange for your agreement to these terms and conditions, We allow you to participate in the Competition with the opportunity to win a Prize.
If you are under 18 years of age (but at least the minimum age specified in the Eligible Entrant section), your parent or guardian must read these terms and conditions and provide their approval before you participate in the Competition and provide your personal information to Us. We may request written confirmation from your parent or guardian that they have provided their approval for you to participate in Our Competition.
Entry
- Only Eligible Entrants may enter this Competition.
- We will only accept Eligible Entries from Eligible Entrants.
- We must receive Eligible Entries during the Entry Period. Any entries submitted outside of the Entry Period will be deemed invalid and will not be considered by the judges.
- We take no responsibility for incomplete, illegible, late, lost or misdirected entries, which will not be accepted.
Entry Method
- Eligible Entries must be submitted in accordance with the Entry Method. You must not exceed the Maximum Number of Entries.
Judging of Eligible Entries
- Eligible Entries will be judged in accordance with the Judging Details and chance plays no part in determining the winners. The judgment by our panel of judges is final and binding and no correspondence will be entered into regarding their decision.
- Eligible Entries which we consider (in our reasonable discretion):
(a) likely to bring Us into disrepute or to damage Our reputation, goodwill, branding or other intellectual property;
(b) to be defamatory, abusive, offensive or obscene;
(c) to be an infringement of third party rights, including intellectual property rights; or
(d) otherwise inappropriate,
will be disregarded by the judges and excluded from the Competition.
Prizes
- The three (3) Eligible Entries which are chosen by the judges as the winners will be awarded either first, second or third place Prizes.
- The Prizes are not transferable and cannot be substituted by the recipient, whether for cash or otherwise.
- You may incur ancillary costs and expenses associated with participating in the Competition and collecting or using a Prize. These costs and expenses are your sole responsibility.
- If a first or second place Prize winner uses their gift card to purchase experiences with the Promoter or its associated companies, the winner acknowledges and agree that:
(a) they will be responsible for reading and satisfying themselves of any additional terms and conditions that apply to the relevant experience(s); and
(b) in some instances, they will need to satisfy additional age, health and/or fitness restrictions which apply to participation in the relevant experience(s).
- Each Prize is subject to availability. If a Prize or part of it becomes unavailable due to circumstances beyond Our reasonable control, We reserve the right to provide a similar product or service of equivalent or greater value to the original Prize, subject to any applicable laws.
Announcement of winners and Prize collection
- Upon judging the winners:
(a) we will publish their scenic photographs on Our website at melbourneskydeck.com.au/photo-competition and on Our Instagram and Facebook social media pages at Melbourne Skydeck, together with the winners’ first names, surnames and State or Territory of residence;
(b) to collect a Prize the winner must contact Us within 7 days of being notified of their win, by either sending us an email to the email address shown in the Contact Details or leaving a comment on the relevant Facebook or Instagram post. We may request reasonable details to confirm the winner’s identity and their adherence to these terms and conditions, and if We are not reasonably satisfied of either matter We may refuse to award the Prize to a winner; and
(c) if a winner does not contact Us within the time period specified above, they will forfeit the Prize and it will be redrawn.
- If you win but are unable to take up the Prize for any reason, We are not responsible for providing you with any alternative prize or compensation of any kind.
- You acknowledge and agree that if you are chosen as a winner, We (and any of our affiliate organisations) may:
(a) publish your full name and State or Territory of residence; and
(b)interview you, with the publication of a short quote from that interview, for Our marketing, promotional, publicity and other business purposes, including without limitation, displaying your name, State or Territory of residence, winning photograph and quote on Our website, social media pages and electronic direct marketing materials. You will not be entitled to any payment or compensation for those activities.
Personal Information
- By participating in the Competition, You consent to Us collecting and processing the personal information that you submit, for the purpose of administering the Competition and to send you marketing and promotional materials regarding Our goods and services. We will handle that personal information in accordance with applicable privacy laws and our privacy policy which is available at melbourneskydeck.com.au/privacy-policy/. We will only share an entrant’s personal information as is necessary to administer the Competition or as agreed by the entrant.
- Personal information that you provide to Us to participate in the Competition will be used for marketing, promotional or advertisement purposes. If you wish to unsubscribe from receiving that marketing and promotional information, please use the unsubscribe function in the emails that We send to you.
Intellectual property
- You represent that you own all intellectual property rights, including copyright, in your Eligible Entry. You grant Us a perpetual, world-wide, royalty free licence, which can be assigned or sub-licensed, to make use of the content within your Eligible Entry for any purpose whatsoever (including to promote Us, any affiliate organisation and our respective goods and services). Our use of your Eligible Entry may include cropping, editing, or otherwise modifying your photograph and We will not always display your name in connection with its use.
- By entering the Competition, you warrant to Us that your photograph is your own original work and is not copied from anyone else’s work nor does it infringe the copyright, trade mark or other intellectual property rights of any person or entity.
General
- You acknowledge that We are under no obligation to use or publish your photograph.
- Except as otherwise required by applicable law, We are not responsible for any loss or damage associated with your entry into this Competition.
- No purchase is required nor is any fee payable to enter the Competition. However you are responsible for any costs you incur in creating and submitting your entry (such as the costs of internet access).
- If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the remaining provisions will remain in full force and effect.
- To the maximum extent permitted by law, you agree to indemnify Us against all claims, costs, expenses and losses We incur as a result of your breach of these terms and conditions.
- To the maximum extent permitted by law, all implied conditions, warranties, guarantees, rights, remedies, liabilities and other terms are excluded from the Competition and these terms and conditions. If any supply under these terms and conditions is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in these terms and conditions excludes, restricts or modifies any provision, right, remedy or liability under the Australian Consumer Law. To the extent that We are permitted to limit Our liability, then Our liability will be limited to:
(a) in the case of services, the cost of supplying the services again or paying the cost of having the services supplied again; and
(b) in the case of goods, the cost of replacing the goods, supplying equivalent goods or having the goods repaired, or paying the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
28. These terms and conditions are governed by the laws of South Australia. The courts of South Australia will have exclusive jurisdiction if any dispute arises in connection with these terms and conditions.
29. The Competition is in no way sponsored, endorsed, administered by, or associated with, Facebook or Instagram. By entering the Competition, you:
(a) release Facebook and Instagram from any liability arising from, or in connection with, the Competition;
(b) must comply with any terms and conditions imposed by Facebook and Instagram which may apply to your participation in the Competition, including but not limited to the use of any intellectual property or branding; and
(c) acknowledge that We may remove any posts you publish on Our website, Facebook or Instagram page, if We deem that post to be inappropriate.

# MELBOURNE SKYDECK BAR 88 MAY 2025 COMPETITION
## TERMS AND CONDITIONS
### 1. ELIGIBILITY
1.1 This competition is open to Australian residents aged 18 years or over.
1.2 Employees (and their immediate families) of Melbourne Skydeck, Bar 88, and their associated agencies and companies are not eligible to enter.
1.3 By entering this competition, each entrant confirms that they are eligible to do so and eligible to claim the prize. Melbourne Skydeck may require entrants to provide proof of eligibility.
### 2. ENTRY PERIOD
2.1 The competition commences at 12:01am AEST on Sunday, 4 May 2025 and closes at 11:59pm AEST on Saturday, 31 May 2025 (“Entry Period”).
2.2 Entries received outside the Entry Period will not be accepted.
### 3. HOW TO ENTER
3.1 To enter the competition, entrants must during the Entry Period:
a) Purchase a Hot Drink/Sweet Treat combo from Bar 88 at Melbourne Skydeck; and
b) Complete the entry form provided by Bar 88 staff at the time of purchase OR scan the QR code provided and complete the online entry form.
3.2 Digital Entry forms must include the entrant’s full name, email address, telephone number, proof of purchase by uploading their receipt and acceptance of these Terms and Conditions.Digital Physical Entry forms must include the entrant’s full name, email address, telephone number, proof of purchase and a staff member stapling their receipt to the form, and acceptance of these Terms and Conditions.
3.3 Each purchase of a Hot Drink/Sweet Treat combo entitles the purchaser to one (1) entry into the competition.
3.4 Incomplete, indecipherable, or illegible entries will be deemed invalid.
### 4. PRIZE DRAW
4.1 The prize draw will take place at Melbourne Skydeck, Eureka Tower, 7 Riverside Quay, Southbank VIC 3006 on Monday, 2 June 2025 at 12:00pm AEST.
4.2 The winner will be selected at random by the Melbourne Skydeck marketing team from all valid entries received during the Entry Period.
4.3 The winner will be notified by email and telephone within two (2) business days of the draw.
4.4 If the winner cannot be contacted or does not claim the prize within 14 days of notification, Melbourne Skydeck reserves the right to withdraw the prize from the winner and select a replacement winner.
### 5. PRIZE
5.1 The prize consists of one (1) Nespresso Essenza Mini coffee machine.
5.2 The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other form of compensation.
5.3 In the event that the prize is unavailable for any reason, Melbourne Skydeck reserves the right to substitute the prize with another prize of equal or greater value.
5.4 The winner is responsible for all expenses and incidental costs not expressly stated as being included in the prize.
### 6. WINNER ANNOUNCEMENT
6.1 The winner’s name may be published on Melbourne Skydeck’s website and social media platforms following the prize draw.
6.2 The winner may be required to participate in publicity related to the competition, including having their name published.
### 7. DATA PROTECTION AND PUBLICITY
7.1 By entering this competition, entrants agree that any personal information provided may be held and used by Melbourne Skydeck or its agents and suppliers for the purposes of administering the competition.
7.2 Entrants acknowledge and consent that their personal information will be used by Melbourne Skydeck for marketing purposes, including but not limited to email newsletters, promotional offers, and event information.
7.3 Entrants may opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in those communications.
7.4 Personal information will be handled in accordance with Melbourne Skydeck’s Privacy Policy and applicable privacy laws.
### 8. GENERAL
8.1 Melbourne Skydeck reserves the right to amend these Terms and Conditions or cancel the competition at any stage, if deemed necessary in its opinion, or if circumstances arise outside of its control.
8.2 Melbourne Skydeck reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these Terms and Conditions.
8.3 Melbourne Skydeck is not responsible for entries not received for any reason, including technical difficulties.
8.4 The competition and these Terms and Conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
8.5 By entering the competition, entrants agree to be bound by these Terms and Conditions.
